LIMITED WARRANTY

  THOMAS-BILT WOOD WINDOWS, as Manufacturer, warrants THOMAS-BILT^® solid Wood Windows and ThomasClad^® aluminum clad Wood Windows against defects in material or workmanship as follows:

Insulating Glass

TBWE3^TM warm edge Insulating Glass used in THOMAS-BILT^® and ThomasClad^® Wood Windows is warranted for a period of twenty (20) years from the date of delivery to the initial customer against failure of the air seal. During the first ten (10) years, THOMAS-BILT WOOD WINDOWS will furnish a replacement piece of insulating glass at no charge.  During the second ten (10) years, THOMAS-BILT WOOD WINDOWS will furnish a replacement piece of insulating glass at fifty (50%) percent the then current list price.

TBWE3^TM warm edge insulating glass with bars between the panes of glass used in Thomas-Bilt^® and ThomasClad^® Wood Windows is warranted for ten (10) years from the date of delivery of the original window or patio door to the initial customer against failure of the air seal. During the first five (5) years, THOMAS-BILT WOOD WINDOWS will furnish a replacement piece of insulating glass at no charge. During the second five (5) years, THOMAS-BILT WOOD WINDOWS will furnish a replacement piece of insulating glass at fifty (50%) percent the then current list price.

This limited warranty does not cover cracked or broken insulating glass, abusive handling or misuse, or shattering due to heat buildup in tempered insulating glass units. In addition this limited warranty does not cover condensation on the room side of the glass. This is not a defect.

The consumer is responsible for installation and replacement of the piece of insulating glass.
THOMAS-BILT WOOD WINDOWS is not responsible for repainting, refinishing or similar activities
involved in the installation and replacement of the insulating glass.

Wood Parts

Wood used in the manufacture of THOMAS-BILT^® and ThomasClad^® Wood Windows is warranted against defects that render the windows and doors unserviceable for a period of three (3) years from the date of delivery to the initial customer. We suggest careful inspection of all products upon arrival and before installation and finishing. In the event that any wood part shall prove defective THOMAS-BILT WOOD WINDOWS will repair or replace at THOMAS-BILT WOOD WINDOWS' sole option, without charge, the defective part.

Texture and color variations do not constitute defects in wood items. To comply with this limited warranty, it is the installer's and/or consumer's responsibility to properly care for and protect all wood against moisture and excessive dryness, and properly paint, varnish or seal all wood surfaces, interior and exterior, top and bottom, by accepted field finishing standards.

THOMAS-BILT WOOD WINDOWS is not responsible for repainting, refinishing or similar activities involved to complete the replacement or repair of the window or door.

Other Parts

All other parts used in the manufacture of THOMAS-BILT^® and ThomasClad^® Wood Windows, including, but not limited to, hardware, screens, and weatherstripping, are warranted against defects in material or workmanship for a period of three (3) years from the date of delivery to the original customer. THOMAS-BILT WOOD WINDOWS will, at its sole option, replace or repair the defective part.

THOMAS-BILT WOOD WINDOWS is not responsible for the repainting, refinishing or similar activities involved in the installation and replacement of the hardware, screens and weatherstripping.

Aluminum frame screens furnished with Thomas-Bilt and ThomasClad Wood Windows  and Patio Doors are designed to keep insects and bugs outside the building. They are not designed to prevent children, adults or pets from falling from an open window or door or otherwise exiting through a window or patio door.

Limitations on Liability

REPAIR OR REPLACEMENT, AS PROVIDED UNDER THIS WARRANTY, IS THE EXCLUSIVE REMEDY OF THE CUSTOMER AND ITS SUCCESSORS IN INTEREST. THOMAS-BILT WOOD WINDOWS WILL NOT BE LIABLE FOR ANY DIRECT OR INDIRECT INCIDENTAL OR CONSEQUENTIAL DAMAGES FOR BREACH OF WARRANTY ON ANY PRODUCT WHETHER IN CONTRACT OR IN TORT, EXPRESS OR IMPLIED, IN LAW OR IN FACT, EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ANY IMPLIED WARRANTY, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ON ANY PRODUCT, OR ON ANY INSULATING GLASS UNIT, IS LIMITED IN DURATION TO THE DURATION OF THE WARRANTY PROVISION APPLICABLE TO THE PART IN QUESTION, AS STATED IN THIS WARRANTY.

Some states do not allow the exclusion or limitation of incidental or consequential damages, or allow limitations on how long an implied warranty lasts, so the limitations and exclusions in the preceding paragraph may not apply to you. This warranty gives you specific legal rights and you may have other legal rights which vary from state to state.

Condition Precedent
THIS LIMITED WRITTEN WARRANTY IS ONLY EFFECTIVE IT THOMAS-BILT WOOD WINDOWS OR ITS DISTRIBUTOR IS PAID IN FULL FOR ALL THE WINDOWS AND DOORS DELIVERED TO THE PROPERTY.
NO OFFICER, EMPLOYEE OR AGENT OF THOMAS-BILT WOOD WINDOWS OR ITS DISTRIBUTORS IS AUTHORIZED TO MODIFY THIS LIMITED WARRANTY.
